Terms of Service

These Terms of Service govern access to and use of Webster AI. They apply to the free workspace and paid plans unless a separate written agreement applies.

1. Provider and scope

Webster AI is provided by Emre Cilesiz, Elzstraße 20, 79261 Gutach im Breisgau, Germany. These terms apply to the relationship between the provider and the person or organisation using Webster AI.

2. Account and access

You must provide accurate information, keep your login credentials secure and use the service only for lawful purposes. You are responsible for activity carried out through your account unless you can show that you were not responsible for it.

3. Service and availability

Webster provides tools for creating, previewing and publishing websites and apps with AI assistance. Features may evolve, and temporary interruptions can occur for maintenance, security, capacity or reasons outside our control. We do not promise that every generated result will be correct, complete or suitable for a particular purpose.

4. Plans, prices and payment

The current plans, prices, included limits and billing intervals are shown on the pricing page and before a paid order is placed. Prices include applicable taxes unless stated otherwise. Paid services are billed through the payment method and provider shown at checkout. Credit-based usage and plan limits are part of the selected plan and are not a guarantee of a specific output.

5. Your content and generated results

You retain your rights in content you provide to Webster. You grant Webster the rights needed to process that content, operate the service, create previews and publish the output at your request. You are responsible for having the necessary rights and permissions for prompts, files, trademarks, personal data and other material you submit. AI results may be non-unique and must be reviewed before publication.

6. Acceptable use

You must not use Webster to violate law or third-party rights, distribute malware, create deceptive or harmful content, attempt unauthorised access, circumvent limits, or interfere with the service or its infrastructure. We may restrict or suspend access where this is necessary to protect users, the service or third parties.

7. Term and termination

You may stop using a free workspace at any time. Paid plans can be cancelled using the account or billing flow made available to you; the applicable cancellation timing is shown there. We may terminate or suspend access for an important reason, including serious or repeated breaches, unpaid amounts or legal obligations. Mandatory statutory rights remain unaffected.

8. Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, and liability under mandatory law. For ordinary negligence, we are liable only for breach of an obligation essential to the agreement and limited to foreseeable, typically occurring damage. This does not change the burden of proof to the detriment of the user.

9. Consumer withdrawal

If you are a consumer, statutory consumer rights may apply, including a right of withdrawal for eligible distance contracts. Any required withdrawal information and instructions are provided before the relevant paid order. Digital-content and immediate-service exceptions apply only where their statutory requirements are met.

10. Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection law provides otherwise. For consumers, the statutory courts remain competent. The place of jurisdiction for merchants and public-law entities is, where legally permissible, the provider’s registered place of business.

11. Credits and usage-based services

Webster Credits are prepaid usage units for Webster services. They are not money, a deposit, electronic money, stored value, or a bank balance, and they cannot be redeemed for cash.

Purchased or consumed Credits are non-refundable, except where applicable law requires otherwise. Mandatory statutory rights, including any consumer withdrawal rights that apply, remain unaffected.

Current Credit prices, usage rates, applicable services, and expiry periods are published on Webster’s Pricing page and in the Credits & Usage documentation rather than as detailed infrastructure prices in these Terms. Webster services may consume fractional Credits.

Usage is determined using Webster’s metering and billing records, except in the case of an obvious error. AI usage consumes Credits according to actual usage. Credits are not automatically restored merely because an AI generation is unsuccessful, incomplete, undesirable, requires regeneration, or does not meet the user’s expectations, except where legally required or where Webster expressly grants a refund.

Included subscription Credits expire according to the applicable plan. Monthly included Webster Credits currently expire at the end of the respective billing period. Purchased top-up Credits currently expire 12 months after purchase. Services that require Credits may be blocked or paused when the available Credit balance is exhausted.

Webster may change future Credit rates or usage pricing prospectively. Such changes remain subject to applicable German and EU law, including mandatory consumer rights and any required notice obligations.
